Overview
Litigation is one of the many avenues we use to move your matter ahead to a final resolution. At times, due to the nature of the disagreement or legal issue, or for enforcement reasons, it is advisable to access the court system. Starting a court process is not a decision to not negotiate. Most families who initiate a court proceeding end up resolving their legal issues in whole or in part without a contested hearing or trial. By appropriately leveraging the dispute resolution services of the family division of the court and using the court system alongside negotiation, most families end up reaching a settlement even after initiating court action.
Protect Your Interests
If your legal issues cannot be settled, and need to be resolved by a family judge, we have you covered. Our lawyers are confident in the court room, recognize the legal issues, effectively present evidence, advance persuasive legal arguments and provide meticulous attention to detail in the drafting of orders. In addition to extensive experience in contested motions, and trials, members of our firm have successfully defended against, and successfully advanced, appeals to the Court of Appeal on varied issues of family law.
Plan For Your Future
We will help you decide whether to initiate a court proceeding, and for which issues. And we have the knowledge, skill set, and experience to see it through all stages of the court process. When litigation is engaged, we strive to proceed in accordance with goals of expediency, financial proportionality, the minimization of conflict on the family and the promotion of cooperation in the process. Members of our firm have been consulted to obtain input on issues of court rules and forms.
If a decision is made to initiate court proceedings, we do not lose track of our underlying mission, and will continue to broach and advise on settlement of individual issues along the way.
